Terms of Service
§01 Definitions
- "Service" refers to the website MRichard333.com, the ZeroTrust Scanner, CVE Tracker, ZeroTrust Browser Extensions (Chrome & Firefox), API endpoints, and any related software provided by the Company.
- "Target" refers to any URL, IP address, domain, or server submitted to the Service for analysis.
- "Report" refers to the output generated by the Service, including safety scores, vulnerability assessments, and technical data.
- "Extension" refers to the ZeroTrust browser extension for Chrome or Firefox installed by the User.
- "Organization" refers to MRichard333, a registered non-profit organization incorporated under the laws of Canada.
- "Platform" refers to the servers and infrastructure hosting the Service, located in the United States of America.
§02 Account Eligibility & Security
2.1 Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use this Service. By registering, you warrant that you are not barred from receiving services under the laws of Canada or other applicable jurisdictions (e.g., sanctioned entities).
2.2 Account Security
You are responsible for safeguarding your account credentials and your JWT authentication token, including as stored by the ZeroTrust browser extension. You agree to notify us immediately of any unauthorized use of your account. The Organization is not liable for any loss or damage arising from your failure to comply with these security obligations.
§03 Acceptable Use Policy
You agree to use the Service only for lawful purposes. The following are strictly prohibited:
- Unauthorized Scanning: You represent and warrant that you own the Target domain or have explicit, written permission from the owner to perform security scans.
- Malicious Use: Using the Service to identify vulnerabilities for the purpose of exploitation, hacking, or unauthorized access to any system.
- Denial of Service: Configuring automated scans in a manner that degrades the performance of the Service or the Target.
- Reverse Engineering: Attempting to decompile, disassemble, or reverse engineer any portion of the Service.
- Extension Abuse: Modifying, redistributing, or using the ZeroTrust browser extension to collect data from third parties without authorization, or to circumvent security controls.
Violation of this section will result in immediate account termination and potential legal action. We cooperate fully with law enforcement regarding illegal activities.
§04 Intellectual Property Rights
4.1 Platform Ownership
The Service — including its source code, scanning algorithms, threat intelligence databases, design, and "Look and Feel" — is the exclusive property of MRichard333 and is protected by Canadian and international copyright, trademark, and intellectual property laws.
4.2 License to Reports
We grant you a non-exclusive, non-transferable, revocable license to access and use the Reports generated by your account for your internal business or personal security purposes. You may not resell or redistribute these Reports without a commercial license.
§05 Fees, Payments & Refunds
5.1 Payment Processing
Payments are processed securely via Gumroad. By purchasing a subscription, you agree to Gumroad's Terms of Sale. We do not store your credit card information on our servers.
5.2 Subscription Terms
Subscriptions automatically renew at the end of each billing cycle. You may cancel at any time via your dashboard. Cancellation takes effect at the end of the current paid period.
5.3 Refund Policy
MRichard333 is a registered non-profit organization. Revenue from subscriptions supports the continued operation and development of the Service.
Subscription payments are generally non-refundable due to the digital nature of the Service (immediate access to server resources). Refunds are granted at our discretion in cases of:
- Proven technical errors (e.g., double billing).
- Service downtime exceeding 48 consecutive hours attributable to the Organization.
Quebec residents: Notwithstanding the above, your rights under the Consumer Protection Act (CQLR c P-40.1) are not waived by these Terms and apply to the extent required by law.
§06 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
- SCAN RESULTS WILL DETECT ALL VULNERABILITIES OR THREATS.
- A "CLEAN" OR "100" SCORE GUARANTEES A SITE IS SAFE.
- THE SERVICE WILL MEET YOUR SPECIFIC REGULATORY REQUIREMENTS (PCI-DSS, HIPAA, ETC.).
- THE BROWSER EXTENSION'S REAL-TIME SCORES ARE EXHAUSTIVE OR INFALLIBLE.
YOU ASSUME FULL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SERVICE.
§07 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MRICHARD333, AS A REGISTERED NON-PROFIT ORGANIZATION, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) CAD $50.00.
Nothing in this section limits liability that cannot be excluded under the Canada Not-for-profit Corporations Act (S.C. 2009, c. 23) or applicable provincial law.
§08 Indemnification
You agree to defend, indemnify, and hold harmless MRichard333, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or connected with:
- Your access to or use of the Service or browser extension.
- Your violation of these Terms, specifically the Acceptable Use Policy.
- Your infringement of any third-party right, including intellectual property or privacy rights.
- Any claim that your use of the scanner caused damage to a third party (e.g., crashing a target server).
§09 Data & Privacy
Our collection and use of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that by using the Service, your Target URLs and scan results are logged in our system history associated with your user ID. By installing the ZeroTrust browser extension, you further acknowledge that the URLs of pages you visit are automatically submitted to our scan API and stored as described in the Privacy Policy.
The Service is operated by a Canadian non-profit organization but hosted on servers located in the United States of America. By using the Service, you consent to your data being processed and stored in the United States, which may have different data protection standards than your country of residence. We apply Canadian privacy standards (PIPEDA, Quebec Law 25) to all personal data regardless of where it is processed.
§10 API Usage
If you access the Service via API:
- You must not exceed the rate limits defined by your subscription tier (Free: 5/hr, Premium: 50/hr, Enterprise: 200/hr).
- You must securely store your API keys and JWT tokens.
- You may not use the API to power a competing SaaS product without an Enterprise Agreement.
§11 Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, including the Canada Not-for-profit Corporations Act (S.C. 2009, c. 23).
While the Service is hosted on infrastructure located in the United States, no submission to US jurisdiction is intended or implied. Users in the United States acknowledge that the Service is operated from Canada and that Canadian law governs this agreement.
Any dispute arising from these Terms shall be resolved exclusively in the courts located in Quebec City, Quebec, Canada, except where prohibited by mandatory consumer protection laws in your jurisdiction.
§12 Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including mechanical, electronic, or communications failure or degradation.
§13 Changes to Terms
We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via email or a dashboard alert. By continuing to use the Service after those revisions become effective, you agree to be bound by the revised terms.
§13b Non-Profit Status & Mission
MRichard333 is a registered non-profit organization. The Service is provided to advance cybersecurity awareness and tooling for the public benefit. Revenue from subscriptions is used solely to cover operational costs (hosting, development, infrastructure) and to fund continued non-profit activities.
Our non-profit status does not affect the binding nature of these Terms or limit your rights as a user. The protections and obligations in these Terms apply equally regardless of our organizational structure.
Volunteers and contributors to the Organization are protected from personal liability under the Canada Not-for-profit Corporations Act and applicable provincial law, to the extent permitted by law.
